Are you fishing or hoping for a free boat ride?
| |
| This morning Joanne and I were talking to some locals on a tiny island where we’re hanging out for a few days. We saw a fishing boat come in right after a pretty violent storm. There were probably 20 guys hanging around the edges of this very small boat. No one is paid for their services – they all fish and keep track of their catch. Typically, they pay the captain and owner of the boat 2 pounds of fish per day for the privilege of fishing from his boat. |

Why NonCompete Means Dont Lie Cheat or Steal
| |
| Scott Kirsner's December 30, 2007 column in the business pages of the Boston Globe caught my eye that morning. His premise... "Why non-compete means 'don't thrive'"... caused me to revisit a favorite client topic... non-compete agreements. They are the subject of more questions, comments and complaints among my small business clients than almost any other, and for a good reason.

Not Every Employer or Employee Needs a Non-Compete!
| |
| It is truly rewarding to write an article which foments discussion... and it doesn't matter whether we agree or disagree, simply that we talk about something which might be important to your business. However, the end result of a non-compete discussion should not necessarily be to foist one of these agreements on every employee. Rather, it should prompt you to think through which of your long-time key employees (or new hires) are in a position to harm your business if they leave tomorrow and join or open a competing company.

What Makes An Employer of Choice?
| |
| Far from business determining the future of the workforce, the workforce now determines the future of business. The dollars that come from work continue to be of major importance but not so the commitment to any one employer. The workers want more than money - they want employment that enables them to achieve their personal dreams and goals. Employers of Choice understand that every employee, or potential employee :
– is on their own personal journey through life, only some of which is spent in the workplace
– has a unique set of life aims and objectives
– chooses workplace cultures that best help them achieve those goals, and
– sees work not as an end in itself but as a means to other ends.

I know I can do more, but I've been doing the same thing for so long I don't know what my skills are or where to start. I don't even know what my passions are. How can I figure out what is my true calling is? |

The Incompetent Interviewer
| |
| If you've been job hunting lately, chances are strong you've run into an incompetent interviewer. My experience is that many people responsible for interviewing see it as a necessary evil. It's not what they want to do so it's something to get over quickly so they can go back to what it is they do well. Don't assume you will be meeting with a polished interviewer. |

Hiring for the 21st Century
| |
| Workforce productivity is the driving force for success in the 21st century, yet many employers are not realizing the levels of productivity from the Human Resources function they could be. The challenge for HR functions within organizations is to implement hiring processes that enhance the productivity of an organization’s workforce. Implementing hiring processes that enhance productivity means hiring more qualified people who are a good fit for the jobs they will be performing, and who become productive more quickly and achieve higher levels of performance. The issue today is how HR accomplishes this task in the most modern, legally compliant, objective, nondiscriminatory and cost efficient manner possible. |

Ethical Dimensions of Business Immigration Practice

| Immigration lawyers are confronted frequently by ethical issues, particularly in the context of representing employer and employee clients in business immigration matters that involve dual representation. As immigration lawyers progress into the broader role of advising companies on compliance issues, a whole host of new ethical issues arise. Work At Home Trumps Having A Job Every Time
| |
| Work at home is a growing trend among people who want to create and control their own income. Work at home trumps having a job every time. A job is defined by the employer. You are hired because you have the skill sets that match the scope of the tasks needed for the job. You will always be limited by what the employer needs to move his company forward. It does not matter how good you are at your job, you will never exceed the expectations of the employer. It is possible to be rewarded for exceptional work with a promotion and higher pay. The opportunities for advancement are limited and the competition can be fierce. No matter how high you climb the corporate ladder you will never reach the top. You can turn that around when you become the owner of your own home based business and are committed to work at home. |

Boomer Business Start-Up Strategy #3

| For centuries, employers have provided a seemingly secure environment for their employees by covering all of the bases. Thus, many who have learned a trade working for their employer for many years may conclude that they could run a business ‘just as well as their employer, maybe even better’…maybe. While that is always a possibility, it is sheer folly to conclude that being a skilled craftsman qualifies one to operate and manage a business. There simply is more to it than what meets the eye. |
