| A very well meaning Director of Franchise Sales and a counterpart on the Internet attempting to draw advertising and leads for them just wrote about their "risk resistant" business.
Rubbish (And, if you want a great recession resistant company get back to me...it has something to do with Rubbish!)
I think we are all using the same vocabulary (we all use the word "risk") but different dictionaries. (I love the concept talked about, Spring Green, for the right market and the right candidate...but not just any candidate with the hope of "risk-resistance".) |

| Trade dress can be protected at common law through the tort of passing off. When trade dress is registered, or registrable under the Trade-Marks Act as a distinguishing guise, it can also be protected through the statutory action found in s. 7(b) of the Trade-marks Act which codifies the common law tort of passing off. A plaintiff must demonstrate goodwill, deception due to a misrepresentation and actual or potential damages. Under the statutory action a plaintiff must further show that the action concerns a trade-mark within the meaning of the Trade-marks Act.

Creating a Culture of High Performance

Heroes in sport may be compared to leaders in organizations. How the members behave and perform is often a result of the example set by leadership. For instance, if a company’s set of published standards are that it values responsibility and accountability, but management often does not abide by these stated principles, employees will, as a consequence, feel it is alright to do the same, thus fostering a culture of deception contrary to the stated value.
What kind of culture exists in your organization? Does it contribute to the personal goals that you, as a leader, have or envision for yourself and your company? Do changes need to happen in your culture, values, beliefs and norms in order to stay competitive and achieve high performance in today’s radically changing business environment? |

What Are You Really Buying?

| I read with great interest the article “Burt’s Bees, Tom’s of Maine, Naked Juice: Your Favorite Brands? Take Another Look — They May Not Be What They Seem“. Andrea Whitfil does a great job unearthing how many natural and organic brands that we perceive as being produced by small companies are in reality now owned by large multinational corporations. And she’s very bothered by the deception. |

MLM Scam Review Sites -- Just More Advertising ?

| We have all seen the ads stating that they have the facts that show which companies are scams and which are not. When you read through the site, you will see many facts and "testimonials" giving details about how unfair the business treats people. There are typically two or three graphically detailed accounts of deception. After you read most of the way through the articles, you come to a point where the author states that he can save you a great deal of money and heartache. Then he lists several companies that he personally recommends, as the best place to invest your money. Seems very logical. Seems as though he is really looking out for your best interest. |

Can sales and medicine mix?

| As you know, I am an advocate for the philosophy that ‘everybody lives by selling something’ and that people buy from people they trust. At its best, selling is about the principle of exchange:- the exchange of value where both parties benefit from open and transparent communication and know what they are engaging in.
So can ‘selling’ be seen as a legitimate role in the various practices of medicine? I.e. GP’s, dentists, optometrists, physiotherapists, surgeons, etc.
If we take it that good selling is where people are fully informed of the facts surrounding their situation, are given legitimate options to choose from, and are in a position to make their own decisions without fear of deception, bullying or intimidation then, yes, selling can form a part of the practice of medicine. |

| On the average an Internet Based Business doesn’t survive beyond twelve months. Finding a business that has made it would have to be described with words like integrity, respect, and commitment, instead of words like greed and deception. |
