| What is it that both Albrecht Durer and Nike understand about the rudiments of branding? In the late Renaissance, Durer’s iconic AD monogram became an emblem of high accomplishment, a symbol of quality applied to the remarkable drypoints made by his studio, and hence, synonymizing value to an educated European intelligentsia. Around 1505, Durer was even forced to denounce the Venetian artist Raimondi, who had copied Durer’s works and signed them with the famous mark. This is one of the first trials defending the rights of an author and the protection of what is today called intellectual property. |

| In order to secure meaningful distribution for a film, a producer must be able to prove that he or she owns, or has a license to use, EVERY piece of intellectual property in the film. “Intellectual property” includes many things, such as the right to use the screenplay, the right to use the music in the soundtrack, the right to use the title of the film, the right to use any brand names that appear in the film, ownership of the actors’ performances and many other issues. It is critical that a producer be very conscious and organized with regard to intellectual property.

| Doing business with China presents many opportunities but with that come many challenges too. Different attitudes towards knowledge and rules means that China is perhaps culturally opposed to the very notion of intellectual property.
Chinese culture respects the knowledge itself and not the ownership of that knowledge and this culture has slowly developed over 5000 years. Moves are being made within China to address the issue of IP ownership, there are more courts, trials and prosecutions but Western organisations will still need to tread with caution regarding their IP rights when it comes to doing business in this exciting economy. |
